Erosion Control & Stormwater Management
Please note that as of January 2, 2007, all aspects of the county Erosion Control and Stormwater Management program, including shoreland erosion control, are administered by the Land and Water Resources Department, in the Lyman F. Anderson Agriculture and Conservation Center, 1 Fen Oak Court, Room 208, Madison, WI 53718, phone 224-3730.
Erosion Control
Dane County has implemented a comprehensive erosion control ordinance to minimize or prevent soil erosion from
various land disturbing activities. As part of this ordinance, you must obtain a permit based on an approved
erosion control plan when any one of the following applies to your project:
- Any land disturbing activity located within 300 feet of navigable rivers and streams, or within 1000 feet of a navigable lake, pond, or flowage; 100 feet of the 100-year floodplain; or 75 feet of shoreland or inland wetlands
- Land disturbing activity in excess of 4,000 square feet
- Land disturbing activity on a slope with a greater than 12% grade
- Land disturbing activity that involves the excavation or filling in excess of 400 cubic yards of material
- Land disturbing activity that disturbs more than 100 lineal feet of ditch or grassed waterway
- Any new public or private roads or access drives longer than 125 feet
- Development that requires a subdivision plat
- Land disturbing activity that disturbs less than 4,000 square feet of land that has a high risk of soil erosion or water pollution
An erosion
control permit application includes a plan and checklist that describes the steps you will take to
prevent soil erosion. Depending on the scope of your project, you may be required to have a professional
engineer develop your plan. The application is filed with Dane County Land Conservation Division of the
Land and Water Resources Department and reviewed. If the plan
conforms to the ordinance requirements, it will be approved; however, if there are deficiencies you will
be asked to amend your plan.
Stormwater Management
Stormwater management differs from erosion control in that its purpose is to control potential run-off problems
for the long term, not just during the construction process. Proper stormwater management can both reduce the
quantity of water running off of a site and improve its quality. A stormwater management permit is required for
the following activities:
- Any development that result(s) in the cumulative addition of 20,000 square feet of impervious surface to the site (since August 22, 2001)
- Agricultural development that creates new impervious surface area exceeding 20,000 square feet on the site
- Any development that requires a subdivision plat, as defined in applicable local land division ordinance(s)
- Any development that requires a certified survey map and is intended for commercial or industrial use
- Redevelopment of more than 4000 sq ft of an existing commercial, industrial, institutional or multifamily use site
- Other land development activities that may significantly increase downstream runoff volumes, flooding, soil erosion, water pollution or property damage, or significantly impact a lake, stream, or wetland area
The review and approval process is similar to that of erosion control. A permit application and plan are filed with Dane County Land Conservation Division of the Land and Water Resources Department and reviewed. If the plan conforms to the ordinance requirements it will be approved; however, if there are deficiencies you will be asked to amend the application.
